These Terms and Conditions govern access to and use of the website, platform, products and services made available by Pilot Training Australia Pty Ltd ("PTA", "we", "us" or "our"), including any student-facing or instructor-facing tools, dashboards, question generation tools, analytics tools, exam preparation content, subscriptions, credit purchases, and associated services made available through www.pilottrainingaustralia.com.au.

By accessing our website, creating an account, purchasing credits, subscribing, requesting or using any PTA service, product, feature or content, you acknowledge that you have read, understood and accepted these Terms and Conditions, our Privacy Policy, and any other policy or notice we publish on the website as applicable from time to time. If you do not agree, you must not use our website or services.

1. About PTA

Pilot Training Australia Pty Ltd is an Australian education technology provider offering aviation theory support tools and related services. PTA provides AI-assisted and instructor-oriented learning resources designed to support student pilots, instructors and training organisations, including content aligned to CASA Part 61 MOS subject areas where stated on the website.

PTA provides training support materials only. Unless expressly stated otherwise, PTA is not a registered training organisation, does not issue licences, ratings or qualifications, and does not act on behalf of CASA in conducting official examinations or granting any aviation authority.

2. Eligibility and Accounts

You must ensure that information you provide to us is accurate, current and complete. You are responsible for maintaining the confidentiality of your login details and for all activity occurring under your account.

If you create an account on behalf of a flight school, business or other organisation, you warrant that you are authorised to bind that organisation to these Terms.

We may suspend or disable an account where we reasonably believe there has been misuse, unlawful activity, attempted unauthorised access, non-payment, or a breach of these Terms.

3. Nature of the Service

PTA may offer AI-generated questions, worked solutions, revision tools, performance analytics, instructor tools, and educational support content. Because some content may be generated dynamically, questions and explanations may vary from session to session.

PTA aims to provide useful, high-quality learning support, but we do not warrant that all content is error-free, uninterrupted, exhaustive, or suitable for every individual learning need. You should exercise independent judgment and, where appropriate, seek guidance from a qualified instructor.

Unless expressly stated otherwise, use of PTA does not guarantee any exam result, pass outcome, licence, employment outcome or regulatory approval.

4. Acceptable Use

You must not misuse the website or services. This includes attempting to copy, scrape, reverse engineer, republish, resell, redistribute, sub-license, exploit or commercially use our platform, question bank logic, AI outputs, instructor tools, code, data, or materials except as expressly permitted by us in writing.

You must not interfere with platform security, attempt unauthorised access, upload malicious code, share account access without permission, or use the platform in a way that is unlawful, abusive, deceptive or harmful to us, our users or third parties.

You must not submit content or use the platform in any way that infringes another person’s rights, including intellectual property, privacy or confidentiality rights.

5. Credits, Pricing and Purchases

PTA may sell access by subscription, package, one-off payment, credit balance or another pricing model disclosed at the point of purchase.

Where the website states that credits are available for purchase, one credit generally represents one mark worth of question content. Credits may be used across eligible subjects or products as described on the website at the time of purchase.

Consistent with PTA’s public FAQ as at the effective date of this policy, purchased credits do not expire unless we clearly state otherwise at the time of purchase or in a specific promotional offer.

All prices are displayed in Australian dollars unless stated otherwise and may be changed prospectively at any time. Changes will not affect completed purchases unless required by law or clearly disclosed in advance.

You authorise us and our payment providers to process payments for purchases you make through the website.

6. Refunds and Consumer Rights

We will comply with the Australian Consumer Law, including any consumer guarantees that cannot lawfully be excluded, restricted or modified.

Where the website or FAQ states that unused credits may be refunded within a short period if you are dissatisfied, PTA may assess such requests in good faith having regard to the timing of the request, the amount used, the circumstances, and any published refund settings or promotional terms current at the time of purchase.

Except where required under the Australian Consumer Law or where we expressly agree otherwise, fees for used credits, consumed services, completed consulting, or already-delivered digital access are generally non-refundable.

7. Intellectual Property

All website content, platform structure, branding, logos, software, question-generation logic, worked solutions, databases, dashboards, graphics, text, audio-visual material and related intellectual property are owned by or licensed to PTA unless otherwise stated.

You receive a limited, revocable, non-exclusive, non-transferable licence to access and use the website and purchased services for your personal study or internal organisational training purposes only, subject to these Terms.

You must not remove copyright notices or claim PTA content as your own.

8. User Content and Feedback

If you upload, submit or share content with us, including comments, feedback, suggested improvements or support requests, you grant us a non-exclusive, royalty-free licence to use, reproduce, adapt and communicate that material to the extent reasonably necessary to operate, improve and support the service.

You warrant that any material you provide to us does not infringe any person’s rights and does not contain unlawful or harmful material.

9. Availability, Changes and Suspension

We may update, modify, withdraw, improve or replace features, content, pricing, credits, subscriptions or functionality from time to time.

We do not guarantee uninterrupted availability of the website or services. Maintenance, upgrades, outages, third-party failures or security events may affect access from time to time.

We may suspend access immediately if reasonably necessary to protect the platform, our users, our rights, or to investigate suspected misuse.

10. Third-Party Services and Links

Our website may contain links to third-party websites, payment processors, analytics providers, learning tools or external content. We do not control and are not responsible for third-party services, terms, availability, privacy practices or content.

12. Limitation of Liability

To the maximum extent permitted by law, PTA will not be liable for any indirect, incidental, special, punitive or consequential loss, or any loss of profits, revenue, opportunity, goodwill, data or business interruption arising out of or in connection with your use of, or inability to use, the website or services.

To the extent permitted by law, PTA’s aggregate liability for any claim relating to paid services will be limited, at our option, to re-supplying the relevant service, replacing the relevant access or credits, or refunding the amount paid for the relevant service or credits giving rise to the claim.

This clause is subject to any non-excludable rights and remedies under applicable law.

13. Privacy

Our collection, use, storage and disclosure of personal information is described in our Privacy Policy. By using PTA, you acknowledge that personal information may be handled in accordance with that policy.

14. Termination

You may stop using the website and services at any time.

We may terminate or suspend your access immediately if you breach these Terms, if your use creates risk for us or others, or where required for legal, security or operational reasons.

Any provisions which by their nature should survive termination, including intellectual property, payment obligations, disclaimers, limitations of liability and dispute provisions, will survive.
